The nation's top prosecutor, Álvaro García Ortiz, has been forced to step down after being convicted of disclosing confidential information in a deeply controversial case that has intensified political divisions within the country.
Judicial Decision and Penalties
The Supreme Court found that García Ortiz had unlawfully revealed information about the tax status of businessman Alberto González Amador, who is the boyfriend of a senior conservative politician.
The court handed down a two-year ban from his post and a penalty of €7,200. Furthermore, he must compensate ten thousand euros to the businessman as compensation.
Political Consequences
The legal proceedings of García Ortiz fueled the previously strained relations between the progressive administration of Prime Minister Pedro Sánchez and the conservative political forces.
Divergent viewpoints were underlined by reactions to the conviction.
"The prime minister must offer an apology to Spaniards, resign and schedule new elections, in that order," said Ester Muñoz for the conservative People's Party.
The government stated it did not agree with the decision but acknowledged it and would move forward with the selection of a new attorney general.
Legal Controversy
However, numerous politicians on the left expressed outrage at what they perceived as a politically motivated ruling.
A cabinet member, of the Sumar party, stated the guilty verdict dealt a "lethal blow to presumption of innocence" and compromised citizens' rights when it came to the rule of law.
Case Background
The complicated legal matter dates back to March 2024, when the prosecutor's department issued a official statement indicating that the businessman had requested a plea bargain after being found to have evaded tax obligations worth over 350,000 euros.
The document corrected mistaken press reports stating that the prosecutor's department had initiated the settlement.
The origin of the false information was the communications director of the conservative regional president of Madrid.
Court Case Details
The businessman lodged a legal action against the attorney general, alleging his privacy had been breached. The legal action against García Ortiz also included allegations of disclosing details about the affair to the media.
Legal authorities highlighted the attorney general's decision to change his phone as suspicious.
However, there was no conclusive proof linking García Ortiz to the leak and multiple reporters testified during the proceedings that he had not been the source of their reporting.
Concerning the press statement, the prosecutor stated he was simply correcting the inaccurate information.
The attorney general can appeal against the decision.
Wider Political Implications
This comes as a severe blow for the national leader, who has been under judicial pressure on various fronts.
- His brother is scheduled for court proceedings for alleged corruption
- His wife is being examined for her business activities
- Former party officials in the Socialist Party are accused of overseeing a massive kickback scheme
